Learn more about your rights as a tenant

The most important thing is to make sure to show up to any court dates and to get legal assistance as soon as possible. Missing a court date can lead to automatically losing your case.

If you’re within one of our service areas (the Charlottesville, Richmond, Petersburg, and Falls Church areas), you can contact us for legal assistance here. If you’re outside our service areas, you can find your local legal aid here.

You don’t have to move right away just because you received a pay or quit notice (the notice that says you will be evicted because you’re behind on rent).
If you pay the full rent within five days of getting the pay or quit notice the landlord can’t proceed with the eviction. If you don’t pay the full rent within five days of the notice, the landlord can go ahead and file for eviction in court.
Some areas have additional local rental assistance available. You can call 211 to check if there’s local rental assistance available in your area.
If you applied for the Virginia Rent Relief Program (RRP) before the cutoff date (May 15, 2022), call the Rent Relief Support Center as soon as possible to see the status of your application. Call 1-833-RENT-RELIEF or (833) 736-8735.

- Calling might be the fastest way to get a response, but you can also email at VAsupport@getgov2go.com or rrp@dhcd.virginia.gov.
- Have your application number ready.
- Keep calling frequently to move your application forward.
- If your application is returned, make sure you fix and upload whatever documents necessary and if you have questions, always call the Support Center.

Always save any correspondence with your landlord, especially notices. If there are legal errors in the notice given to you by your landlord you may be able to prevent or delay your eviction.

If you are in court for nonpayment of rent, when the judge calls your name you should say:

I disagree with the charges brought by my landlord.
I want a trial.
I want a Bill of Particulars.

After that, here’s what will happen:

- The judge will order the landlord to produce a “Bill of Particulars”, which will give the amount they say you owe. If your landlord does not produce a Bill of Particulars they could automatically lose the case.
- The judge will also order you to produce a “Grounds of Defense”, explaining why you should not be evicted. If you don’t produce a Grounds of Defense you could automatically lose the case.
- The judge will give you a trial date.

Make sure you get the due date for the Bill of Particulars and your Grounds of Defense as well as your next court date. Go to your court date. If you don’t, you will automatically lose the case.
If your landlord wins a court case against you, you will have a 10-day appeal period during which you cannot yet be made to leave. After that 10-day appeal period the Sheriff can serve you a notice, after which you have to leave within 72 hours.
At your hearing you should tell the judge if you have applied for any form of rent relief.
