Support ending 287(g) agreements in Virginia and open collaboration with ICE

We are collecting organizational, local governments, businesses, and faith-based sign-ons in support of HB1438, patroned by Delegate Guzman, that ends 287(g) agreements and limits voluntary collaboration between Virginia agencies with immigration enforcement.  

Sign-Ons will be shared with members of the Virginia General Assembly.

We, the undersigned organizations, local governments, faith institutions, and community leaders, urge the General Assembly to pass HB 1438 that ends 287(g) agreements and limits voluntary collaboration between Virginia state and local law enforcement and immigration enforcement.  

287(g) agreements and non-mandatory open-ended collaboration with ICE have led to violations of due process, unlawful detention without judicial warrants, and fear in immigrant communities. When local law enforcement is used to enforce civil immigration law, trust breaks down, people stop reporting crimes, and public safety suffers.  

Virginia has seen the long-term harm of these policies before. In places like Prince William County, unwelcoming immigration enforcement damaged community trust and public safety. This bill ensures that those mistakes are not repeated and establishes clear, statewide standards.  

This legislation: 

  • Ends 287(g) agreements that deputize local and state law enforcement as immigration agents; 
  • Prevents detention based solely on civil immigration violations without a judicial warrant;  
  • Keeps local law enforcement focused on public safety, not immigration enforcement; and 
  • Preserves compliance with state and federal law.
